The Differences Between Joint And Sole Child Custody
There are basically two types of child custody that can be awarded by the courts in South Africa to parents of minors. The most common of these is joint custody where each parent retains all their rights towards the minors. While joint custody can means that the children live with both parents according to a predetermined schedule, this is not a prescription of joint custody.
The other type of child custody is sole and is awarded to only one parent and the other parent will loose all their legal custodial rights towards the child. Abuse, neglect or some other extreme conditions need to be awarded in sole custody cases. While the child will live with the custodial parent, the non-custodial parent will retain visitation rights as determined by the court.
